Tom Silvagni, the son of renowned AFL player Stephen Silvagni and TV presenter Jo Sivagni, is appealing his rape convictions, arguing that a judge's description of evidence as 'incriminating conduct' was in error. Silvagni was sentenced to six years and two months in prison after a County Court jury found him guilty of two counts of rape in December 2025. The court heard that Silvagni, in January 2024, climbed into a woman's bed, pretending to be another man, and raped her twice. He then tampered with an Uber receipt to cover his tracks. Silvagni's appeal, filed earlier this week, focuses on two grounds. Firstly, his lawyers argue that the trial judge, Greg Lyon, erred in determining that statements made by Silvagni during a secretly recorded phone call constituted incriminating conduct. Secondly, they claim that the judge erred in his instructions to the jury regarding the permissible use of this evidence. During the sentencing, Judge Lyon highlighted Silvagni's crimes as planned, cunning, and strategic, and noted his lack of remorse. Silvagni's victim, in a pre-sentencing hearing, shared her lifelong trauma, including post-traumatic stress disorder, caused by the attack. She stated, 'Tom Silvagni, you raped me. Not once, but twice. You know this, I know this, and now so does everyone else. That moment haunts me every single day.' Silvagni is facing a non-parole period of three years and three months.
